Terms of Service

1. Services

Kakmaklik provides website design, development, hosting, and ongoing support services for small businesses. Service details and pricing are as described on our website and in any written proposal or agreement.

2. Pricing and payment

Prices are quoted in South African Rand (ZAR) and are subject to change. A once-off build fee is payable before work begins. Monthly retainer fees are billed in advance and cover hosting, security, and support as described in the chosen tier.

3. Ownership

You own all content you provide (text, images, logos). You own the completed website design and code. Your domain name remains your property. We retain the right to showcase the work in our portfolio unless otherwise agreed.

4. Support

Monthly support is capped at 30 minutes per month on the Lead Site + CMS tier and above. Unused time does not carry over. Changes exceeding the support cap are quoted separately.

5. Cancellation

You may cancel the monthly retainer at any time with 30 days' notice. Upon cancellation, we will provide all website files and assist with domain transfer if requested. Once-off fees are non-refundable after work has commenced.

6. Liability

We take reasonable care to ensure your website functions correctly. We are not liable for losses arising from third-party services (hosting providers, domain registrars, payment gateways), content you provide, or downtime outside our control.

7. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.
